We may alter these Terms at any time without specific notification and changes apply from the revision date. By continuing to use the Service post revision, you agree to the updated Terms so please check regularly. Violation of new Terms warrants account termination.

User Eligibility and Accounts

To access most features of the Service to make purchases, enroll in programs etc, you must register an individual user account which requires submission of certain personal details. Multiple accounts creation is prohibited. You must be at least 18 years to use this Service independently. Persons under 18 can use it under parental guidance.

You are responsible for maintaining confidentiality of your login credentials and all activities through your account. Inform us immediately of unauthorized account use so we may take appropriate action.

You may submit suggestions, ideas, insights, testimonials or other content as allowed on the platform. You are solely responsible for any content you upload and must have full authority and rights for the same. By sharing content, you grant Inclusys unconditional rights to publish it for our promotional or operational purposes across channels and regions subject to privacy rights.

You warrant that your content complies with applicable laws and will not violate others rights or terms of service. Objectionable content like threats, abuse, inappropriate content etc will be removed and may result in account termination.

Purchases & Payments

Certain assistive technology products or data services may be available for purchase through the platform. Product listings provide key information like features, specifications, pricing etc. Inclusys strives for accuracy of listings but cannot be held liable for errors or omissions. Product images are illustrative. Please check current Product Terms prior to ordering.

Payment involves sharing relevant purchase and personal details needed to complete orders and comply with accounting, billing requirements under applicable laws. By placing an order, you consent to sharing these details with third party service providers strictly for order fulfilment like payment processing, order delivery etc.

Applicable taxes will be calculated and charged automatically during checkout process. In case of cancellation, taxes paid shall be non-refundable. Further cancellation, returns and refunds for orders are allowed in accordance with respective Product Terms and applicable laws.

Cancellation by Inclusys Neuro Org

Inclusys reserves the unconditional right to cancel any orders that violate Terms, Product Terms or applicable laws or appear suspicious or fraudulent in nature. Reasons for cancellation may not be disclosed due to security reasons.

Delivery of Purchases

We shall make best efforts to deliver orders to the delivery destination within timeframe indicated in Product Terms or order process but cannot guarantee exact delivery dates. Delayed delivery or performance issues with products should be immediately reported to us by following instructions in respective Product Terms.

Intellectual Property

The Service including the Inclusys brand name, logo, graphics, content, designs, products, applications etc are the intellectual property of Inclusys protected by copyright, trademark patents and other applicable laws. Copying, redistribution or misuse can result in infringement proceedings. Content sourced from third parties will contain indicators of ownership where applicable.

Disclaimer

Inclusys provides offerings on reasonable skill and effort basis without guarantee of specific outcomes or warranties of merchantability or fitness.. We shall not have any liability for any indirect or direct loss arising due to use of this Service or offerings barring gross negligence or willful misconduct.

Indemnity

As a user, you shall indemnify Inclusys Neuro Org from legal proceedings, losses, claims or damages arising from your violation of these Terms, applicable laws or rights of any third party. Users agree to cooperate fully with Inclusys in defense of such proceedings.

Termination

Your access to the Service may be terminated by Inclusys due to reasons like prolonged inactivity, violations of Terms and other policies, discontinuation of offerings in your region etc. This may result in loss of data associated with your account. Certain provisions of Terms like indemnity, intellectual property etc shall survive termination.

Governing Law and Dispute Resolution

These Terms shall be governed exclusively by the laws of India for users within India and by the laws of the United Kingdom for users residing within the United Kingdom, without regard to conflict of law provisions. Any disputes arising with respect to the Service shall be subject to the exclusive jurisdiction of courts in Kochi, India (for Indian users) or courts of competent jurisdiction in the United Kingdom (for UK users).

No Liability

Inclusys will not have any liability to the user for any issues arising from the use of technology products purchased or data services availed through the platform. This includes any performance, quality, safety, legal compliance or suitability issues with the products/services.

The user shall perform adequate research and use their judgment before ordering products or services via the platform. Inclusys is simply providing access to these offerings as a technology intermediary. We do not provide any guarantees or endorsements regarding fitness, merchantability, safety or legal clearances for the products/services.

Any liability arising from issues with products or services purchased/availed by the user shall be the sole responsibility of the user and the respective seller/provider. Inclusys shall not be held legally or financially liable whatsoever towards the user for the use of any offerings accessed via our platform. The user assumes full risk as to the quality and performance of such products or services.
